RECORDING FEES
MOBILE COUNTY PROBATE COURT
Effective date January 1, 2000

RECORDATION STAMP
Recordation stamp is $1.00 on each and every instrument recorded.
SPECIAL RECORDING FEE (SRF)
$2.00 fee charged on each and every instrument recorded.
SURCHARGE
$10.00 charge on all taxable documents.
RECORDING FEES ON DEEDS
The cost of recording is $2.50 per page. If there is not enough space for affixing the recording stamp (2 ½" x 2 ½") a blank page will be added and an additional $2.50 for that page will be collected.
DEED TAX
Deed tax is 50 cents per each $500.00 or fraction thereof on the value of interest being conveyed. We always round up in increments of $500.00 (example $501.00 would round up to $1,000 and a $1.00 deed tax would be collected.)
VENDOR'S LIEN DEED
To compute the cost of recording a vendor's lien deed, refer to the method noted above. Deed tax on a VLD is figured on the cash consideration (amount paid down - or value of interest conveyed). The mortgage tax is computed as hereinafter set forth on the unpaid balance represented by the vendor's lien.
DEED WITH THE ASSUMPTION OF A MORTGAGE OR VENDOR'S LIEN
The cost of recording is computed as mentioned above and a deed tax is figured on the equity when a recording reference is given as to where the mortgage or vendor's lien is recorded. The original recorded lien must be made to a taxable institution or individual, otherwise tax will be due on the total value of interest being conveyed.
MORTGAGE AND MORTGAGE TAX
The cost of recording a mortgage is the same as recording a deed, that is $2.50 per page, $1.00 recordation stamp, $2.00 SRF, plus $10.00 surcharge. Mortgage tax is figured at the rate of 15 cents per each $100.00 or fraction thereof on the amount of the mortgage. We always round up to the next $100.00 (example $100.01 would round up to $200.00 and the mortgage tax due would be 30 cents)
SIMULTANEOUS RECORDING OF DEED AND MORTGAGE (PURCHASE MONEY)
The mortgage tax and fee for recording the mortgage will be calculated as outlined above. The deed tax will be figured on the amount of the sales price exceeding the amount of the mortgage, if the mortgage is made to a taxable concern and the mortgage tax collected. If the mortgage is made to a non-taxable concern then the deed tax will be charged on the total value of interest being conveyed.
MISCELLANEOUS DOCUMENTS
On miscellaneous documents, such as affidavits, powers of attorney, transfers of mortgages, releases of lien, etc. the fee will be $2.50 per page, $1.00 recordation stamp, plus $2.00 SRF.

On releases of mortgages or vendor's liens the fee will be $1.00, $1.00 recordation stamp, plus $2.00 SRF. If you have more than one book and page reference, an additional $1.00 per reference will be collected. (An assignment reference would not count).

Mineral conveyances are 15 cents per acre on non-producing properties, minimum of $1.00. Present reservations by grantors are 15 cents per acre.
OIL, GAS AND MINERAL LEASES
The costs of recording is $7.50 per page, $1.00 recordation stamp, $2.00 SRF, plus $10.00 surcharge. A deed tax is figured on the bonus consideration paid and a mineral tax of 05 cents an acre on a lease with a term of ten years or less, 10 cents per acre on a lease of more than ten years and not exceeding 20 years and 15 cents per acre on a lease that is for more than 20 years, a minimum of $1.00.
COLLATERAL ASSIGNMENT
When the collateral assignment is used as security for a note that will not be recorded, the collateral assignment becomes taxable. The fees are $2.50 per page, $1.00 recordation stamp, $2.00 SRF, $10.00 surcharge, plus the mortgage tax on the indebtedness being loaned.
NAMES ON INSTRUMENT FEE
If the instrument conveys an interest in real or personal property within this state and recites more than two grantors or grantees, mortgagors or mortgagees, lessors or lessees, transferors or transferees, assignors or assignees, buyers or sellers or vendors or vendees, an additional fee for indexing each name in excess of two entrees in the direct index or two entered in the reverse index shall be $1.00 per name.
INCORPORATION
$38.00 - For recording profit-making incorporations $36.00, plus $2.00 SRF . (Plus $40.00 to the Secretary of State)
$28.00 - For recording non profit incorporations $26.00, plus $2.00 SRF. (Plus $20.00 to the Secretary of State)
PLATS AND MAPS
For recording plats and maps for each lot contained therein, 50 cents per lot, but in no case more than $200.00 for one map, nor less than $11.00 for one map, plus $2.00 SRF.
CLAIM AGAINST ESTATE
$4.50 - Filing and docketing each claim $2.50, plus $2.00 SRF.
CERTIFICATE OF JUDGMENT
$5.50 - For recording a certificate of judgment $3.50, plus $2.00 SRF.
NOTARY PUBLIC BOND
$14.00 - For recording notary public bond $12.00, plus $2.00 SRF.

UNIFORM COMMERCIAL CODE FILING FEES

$10.00 Surcharge on all taxable documents filed in Mobile County's public records.

In addition to the special Mobile County surcharge,
the following fees are in effect as of January 1, 2002:
